Terms of Service

The ground rules for using our website and working with us.

Last updated: October 27, 2026

These terms apply when you use the Jakai Consulting website, call or text our lines, or use our services. Jakai Consulting LLC is called "Jakai," "we" or "us" here, and "you" means you and, if you're acting for a business, that business. By using our website or services, you agree to these terms.

Who can use our services

You must be at least 18 years old and able to enter into a binding contract to use our services. If you're using them for a business, you confirm you have the authority to agree to these terms for that business.

Our services

We help small businesses set up AI and automation systems, such as call and text handling, follow-ups, scheduling, connected business tools and websites. The descriptions on our website are general. The exact work, price and timeline for any project are set out in a written proposal or agreement. If that agreement conflicts with these terms, the agreement controls.

Quotes, fees and payment

  • We quote each project after a discovery call. Quotes are valid for the period stated on them.
  • Most projects include a one-time setup fee and a monthly fee for hosting and support. Usage such as texts, call minutes and AI is billed separately.
  • Software subscriptions are in your name and billed by the vendor unless your agreement says otherwise.
  • Payment terms, commitments and cancellation are set out in your agreement.

No guaranteed results

Our systems are built to save time and help you respond to customers. We don't guarantee any particular result, such as more leads, more revenue, hours saved or a specific timeline, because those depend on many things outside our control, including how the systems are used.

Third-party tools

Most of what we set up runs on tools made by other companies. Your use of those tools is subject to their own terms and pricing, which can change. We aren't responsible for outages, changes, price increases or data handling by those providers, though we'll help you work through issues that affect your setup.

Your responsibilities

  • Give us accurate information and the access we need to do the work.
  • Use the systems we set up lawfully. That includes getting any consent required to call, text, email or record your customers, honoring opt-outs, and giving any notices the law requires, such as call-recording notices.
  • Review messages, invoices and other items the systems draft for your approval before they go out.
  • Keep your account logins secure. We use manager or team access and never ask for your passwords.

Ownership

You own your accounts, your data, your customer list and the content you provide, including your website content. We keep ownership of our own know-how, templates, workflows and materials we created before or apart from your project. Once you've paid for a project, you may use what we built for you in your business, as set out in your agreement.

Calls and text messages

  • Our phone line is answered by an AI assistant. Calls are recorded and transcribed so our team can follow up. By staying on the call after the notice, you agree to the recording. If you'd rather not be recorded, tell the assistant and we'll call you back.
  • If you agree to receive texts from us, we may text you about your inquiry, appointments and our services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Carriers aren't liable for delayed or undelivered messages.

See our Privacy Policy for how we handle call and text information.

Using our website

You may use our website for lawful purposes only. Don't try to disrupt it, gain unauthorized access, copy it in bulk or use it to send spam. The site's content, design and logo belong to Jakai and may not be reused without permission. Information on the site is general and isn't legal, tax or financial advice.

Disclaimers

Our website is provided "as is." Except as stated in a written agreement with you, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, Jakai won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to our website or services is limited to the amount you paid us for the services involved in the three months before the claim arose.

Indemnification

You agree to defend and indemnify Jakai against claims arising from your misuse of our website or services, your violation of these terms or the law, or how you communicate with your own customers through the systems we set up.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Massachusetts, unless your agreement says otherwise.

Changes to these terms

We may update these terms from time to time. When we do, we'll change the "Last updated" date at the top. Continuing to use our website or services after an update means you accept the updated terms.
